Privacy policy

Protecting the people who shop with Viva Home, and the details they trust us with, matters to us. Below you'll find how personal information is handled when you use our website, on any device.

Our Privacy Practices

What we collect

  • Ways to reach you: your name and email, and in some cases a postal address and phone number.
  • Payment information: card number and billing address when you buy from us.
  • Things you post or send: for example product reviews, which are visible to everyone on our site.
  • Demographics: details like age, gender, and the home styles you prefer.
  • Browsing and location data: your browser type, the page that referred you, where you head after leaving, and possibly your approximate location.
  • Device data: identifiers for your device and its IP address.

Where it comes from

  • You tell us, such as when you open an account, check out, enter a promotion, or reach out to our team.
  • Automatic tools. Cookies, web beacons, and similar technology on our site and in our emails record how you use them over time. Outside companies may gather information this way on our behalf.
  • Other sources. Social networks and the companies we partner with for business and marketing may pass along details about you. A fellow shopper might also give us your contact information, for instance to share a wish list with you.

Bringing information together

Details from separate channels, such as our website and our emails, may be merged, and anything a third party gives us may be added to the profile we already have for you.

How we put it to use

  • Replying to you: answering questions, feedback, and reviews, or telling you that you've won a promotion.
  • Making things better: refining our site and products and tailoring your visits, for example with reminders about items left in your cart.
  • Security: safeguarding Viva Home, our shoppers, and our website.
  • Marketing: sharing new arrivals and deals, and displaying ads for our offers and for third-party offers we think you'd like.
  • Keeping you informed: about your orders, the reviews or comments you leave, and any updates to this policy or our site terms.
  • Texts, with your permission: if you share a mobile number and opt in, we may text you about orders, deliveries, support, carts you left behind, and promotions. Carrier message and data rates may apply, how often we text varies, and you never have to agree in order to buy.
  • Any other purpose allowed by law or that we explain to you.

When we share it

  • Companies working for us, including those that handle our emails, host and run the site, offer customer financing, and carry out deliveries.
  • Business and marketing partners, like co-sponsors of a promotion and firms that support our marketing, social networks included.
  • When the law or safety calls for it, for example to answer a subpoena, court order, or government or investigative request, or to look into suspected fraud, including in a promotion. Promotion winners' details may be given to anyone who requests the list of winners.
  • A buyer of our business, if some or all of it changes hands, as part of that deal.
  • Anything else we explain to you.

We never pass mobile information, including your text opt-in and consent records, to outside companies for their own marketing. Companies that send texts for us may use your details only to deliver that service to Viva Home.

The choices you have

  • Promotional emails: follow the unsubscribe link in any marketing email. Messages about your orders and requests will still reach you.
  • Texts: reply STOP at any time to stop them, or HELP for assistance, or write to support@vivafurn.com. Messages about your orders may continue.
  • Cookies and tracking: adjust or block cookies through your browser settings.
  • Your device: switch off location services whenever you like.
  • If you live in California, the California Consumer Privacy Act of 2018 and the California Privacy Rights Act of 2020 give you further rights, explained in the next part of this policy.

Children

Viva Home is intended for adults. We don't knowingly gather personal details from anyone under 13 without consent from a parent or guardian. If you think a child under 13 has given us information, write to support@vivafurn.com and put "COPPA Information Request" in the subject line.

Security

We rely on industry-standard safeguards, yet nothing sent over the internet is ever fully secure, so we can't promise complete safety when you use our site. Take care online, and keep your passwords to yourself.

Other websites and services

Links or features from outside companies may appear on our site. Their privacy practices fall outside this policy and outside our responsibility, so please review their own privacy policies before sharing anything.

Updates to this policy

This policy may change over time. When changes are significant, we'll tell you as the law requires, and the latest version will always be posted on our site, so it's worth checking in now and then.

California Privacy Rights and Notice

If you live in California, the California Consumer Privacy Act of 2018 ("CCPA") and the California Privacy Rights Act of 2020 ("CPRA"), referred to together as the "California Privacy Act," give you extra rights. This notice belongs to our Privacy Policy, includes everything explained above, and will be revised as the law and its regulations evolve. Any term the California Privacy Act defines carries the same meaning here.

Business purposes for using information

Personal information may be used or disclosed for these business purposes:

  • Doing what you gave it to us for, such as completing and shipping your purchase.
  • Supplying the information, products, or services you request, handling your questions, comments, and reviews, and tracking orders.
  • Emailing you about products, services, events, or news you may find useful.
  • Enhancing our site and products, tailoring your experience, and loading our pages more quickly.
  • Marketing, such as new arrivals, deals, promotions, and advertising, whether direct or through social networks, which may feature other companies' offers.
  • Contacting you, for example about an order.
  • Fulfilling our contractual duties and enforcing our rights, including billing and collections.
  • Testing, research, analysis, product development, and security.
  • Protecting the rights, property, or safety of Viva Home, our shoppers, or anyone else.
  • Answering law enforcement and meeting legal, court, or regulatory requirements.
  • Any purpose explained to you at collection or otherwise permitted by the California Privacy Act.

Categories of recipients

For business purposes, personal information may go to the following kinds of third parties:

  • Companies you allow us to share with for products or services that we or they provide to you, such as financing providers and delivery carriers.
  • Providers that support our operations, including web hosting, analytics, and other technology vendors.
  • Business and marketing partners, such as social networks, promotion co-sponsors, and email services.
  • Government, regulatory, or investigating bodies, or other third parties, where we believe disclosure is needed to meet legal duties or to protect our rights or someone else's.
  • Our affiliates, and those involved if our business is sold, assigned, or otherwise transferred.

The CPRA lets California residents opt out of having personal information shared with third parties for cross-context behavioral advertising, except where those parties are service providers or contractors. Any information we share for that purpose goes only to service providers and contractors who are contractually required to use it solely for work they do for us.

Shopify and how it processes data

Viva Home is built on Shopify Inc., the e-commerce platform that powers our store. Shopify may handle personal information both for us and for its own purposes, such as running and improving its platform.

Shopify tools like Shopify Network Intelligence and Shopify Audiences may help us understand how shoppers interact with our store, personalize what you see, and make our ads more relevant. This means your personal information may be:

  • Handled by Shopify for personalization, analytics, and ad optimization
  • Passed to third-party partners, some outside the United States, where the law permits
  • Used to improve Shopify's services and how well our store performs

Details are in the Shopify Consumer Privacy Policy at https://www.shopify.com/legal/privacy. If you live in a U.S. state that gives you the right to opt out of sharing for targeted advertising, use our Do Not Sell or Share My Personal Information page or email support@vivafurn.com.

Chatting with us online

When you message us through online chat, we keep the conversation and anything you include in it, such as your name, email, and order details, and our chat provider processes it to run the service. We use it to answer you, help with your order, and follow up. Replies may be generated automatically with AI, and a member of our support team may read the chat and take over. You may need to enter your name and email before the chat begins.

Visitors outside the United States

Depending on local law, people in other countries, including the United Kingdom and the European Economic Area, may have further rights, for example to object to or limit some processing, or to withdraw consent where processing relies on it. Email support@vivafurn.com to use these rights, and visit https://privacy.shopify.com for more on how Shopify processes personal data.

Using any privacy right will never lead to unfair treatment. Before acting on a request, we may need to confirm who you are, and you may appoint an authorized agent to act for you, subject to verification.

How long information is kept

Personal information is kept for as long as its original purpose and the law require. Once we no longer need it, we erase it or strip out anything that identifies you, though some records may be retained to meet legal, accounting, or reporting duties.

Access and portability

You can ask what personal information we've collected about you and how we've used it in the last 12 months. Once your request is received and verified, we'll share:

  • Which categories of personal information we hold about you
  • Which categories of sources supplied it
  • Our reasons for collecting it
  • Which categories of third parties received it
  • The specific pieces of personal information we collected

In line with the California Privacy Act, we won't hand over your Social Security number, driver's license or other government ID number, account numbers, health insurance or medical ID numbers, account password, or security questions and answers. We may also hold back specific details if disclosing them would create a substantial, articulable, and unreasonable risk to their security. If you'd like a portable copy, we'll send one after verifying your request.

Correcting your information

If any personal information we hold about you is inaccurate, you can ask us to fix it. After receiving and verifying your request, we'll make the corrections the California Privacy Act requires.

Deleting your information

You can ask us to erase personal information we collected from you, with some exceptions. After receiving and verifying the request, we'll delete it and instruct our service providers to do likewise, unless an exception applies. Deletion may not remove every trace, such as content you've posted, and any further interaction with us will generate new information.

We may refuse a deletion request when we or our service providers need the information to:

  • Finish the transaction it was collected for, supply a product or service you asked for, act as reasonably expected in our ongoing relationship, or otherwise fulfill our contract with you
  • Spot security incidents, guard against malicious, deceptive, fraudulent, or illegal activity, or pursue those responsible
  • Debug products to find and repair errors that affect how they're meant to work
  • Exercise free speech, protect another consumer's right to it, or use another right the law provides
  • Comply with the California Electronic Communications Privacy Act
  • Carry out public-interest scientific, historical, or statistical research, public or peer-reviewed and consistent with ethics and privacy laws, where deletion would likely make the research impossible or seriously undermine it, and you gave informed consent earlier
  • Support only internal uses that reasonably match what you'd expect from your relationship with us
  • Meet a legal obligation
  • Make other lawful internal uses that fit the context in which you shared the information

Submitting a request

Send access, correction, or deletion requests to support@vivafurn.com. Access requests are limited to two in any 12-month period. Each request needs to:

  • Include enough detail for us to reasonably confirm that you're the person whose information we hold, or their authorized representative
  • Explain what you're asking for clearly enough for us to understand, assess, and answer it

We can't act on a request or release personal information unless we can confirm your identity and that the information is yours, or that an agent truly has your authorization. To confirm who you are, we'll ask for details such as your name, email, phone number, or address and compare at least two, often three, with our records. Requests for specific pieces of information also require a statement, made under penalty of perjury, that the request concerns you.

When you'll hear back

You'll get confirmation that we received your request within 10 days, and we aim to fully respond within 45 days. Should we need longer, up to 90 days in total, we'll tell you, as the California Privacy Act permits.

Equal treatment and request reporting

Exercising your rights under the California Privacy Act will never result in unfair treatment from us. The CCPA also requires us to make information about the requests we receive publicly available.
